Charlotte, NC asked in Criminal Law for North Carolina

Q: What can I do to have my father arrested for committing a serious crime against my wife?

We have the investigation report showing he completed the crime and him admitting it. But he has people to do things for him (his words) and it is a serious crime. A judicial official in Durham NC helped him and I believe that’s why nothing is being done. He has stalked her, chased her all through town and has even tried to get to her in a public establishment that the doors were locked on. And taken out false police reports on her acting as if he were me. She was arrested but has never gone to court for any of the charges that seem to have disappeared, other than the originals that are in a safe place away from him. A Raleigh police officer looked at the investigation report and told us both, that with that paper showing he did complete the crime, that he should have already been arrested Bc it held a 30 year sentence. His judicial friend got her phone records and gave to him but nothing has happened yet. What do we do?

A: Your story just doesn't add up. If he has stalked her - just go to your local magistrate and swear out a warrant. If you can't get a warrant, odds are it didn't amount to stalking rather than mysterious 'official forces' are conspiring against you. Also, describe events clearly and accurately - it is simply not true that he chased he "all through town" - that simply did not happen. While he may have chased her through some specific portion of town maybe even a significant portion, I assure you that portion of town was not "all through town". I'm not even sure what trying "to get her in a public establishment that the doors were lock on" even means or how it matters?" If the doors were locked, how was he supposed to get her in there and for what purpose? And if the doors had been unlocked - so what? It's a public establishment. If you have evidence of crimes - again go to your local magistrate and swear out a warrant or consult with a local attorney who can review your situation in more detail and lay out potential options for you. I can tell you this much, if you go to local attorneys with the same odd, inaccurately described, cloak and dagger story you have presented here, they are all likely gonna tell you you have no case. Which based on this description, would likely be my assessment. Bring your documents and be specific and factual in the description of the events. Best of luck.
