Los Angeles, CA asked in Car Accidents and Civil Litigation for California

Q: I am being sued for a vehicle I have never owned. What do I need to do to make this go away?

I received a Summon and responded by filling out form PLD-PI-003 denying all allegations, filed (Los Angeles Country Superior Court House) and registered forms before mailing to Attorney. I received a 2nd Notice (Request for Admission) and responded by denying all allegations. I once again, filling out form PLD-PI-003 denying all allegations, which are false. For example, to accept I gave permission to an individual (unknown to me) to drive a vehicle I have never owned. In addition, to accept that I stated in writing to pay a debt of the sum of $21, 176.11, which I have no knowledge of ever doing. I received another Notice of Motion for Order Compelling Response to Interrogatories and for Sanctions Thereon which includes additional cost associated with the this motion ($800.00) I don't know what to do. Just in case , I requested from the Department of Motor Vehicles a list of vehicles registered under my name, confirming I never owned this vehicle.

A: Sounds like you need to hire an attorney. You have the opportunity to defend yourself and prove that you have no liability. You are blowing it by not responding to interrogatories in a timely fashion.
