Q: I live in Ca. & my dghtr, (w/our leashed Puppy), rang a d/bell & was greeted by a pitbull taking our dogs neck swinging

him left & right, my dghtr ran for her life screaming for help. At the time I was more concerned about getting to safety that I don't know what happened to our dog. After the attack a woman came outside called her dogs back in the yard & into the house & closed the door behind her. She didn't speak not one word to us.

At home I called Animal Control & they said they were on there way out with the police. They came out 3 days later w/out the police. It was 4 days before i was successful to make contact with anyone from the house. With whom I left my name & # where to reach me about the attack. When the woman text msg me she states that its not her dog its her husbands. And that no one has ever placed a un neutered dog under her dogs nose before. Animal Control said the dog was in his yard so they did nothing wrong. There are no beware of dog signs anywhere on her property, the front yard has a gate around it however it was wide open. She said look into the animal shelters and adopt a

A: You have to prove that the dog owner was negligent. It is unclear that you can. If you do prove negligence, your damages are the cost of veterinary care and/or the value of the dog, if it died. These are ordinarily cases which are suited for Small Claims.
