Q: Was offered 5 years prob & pay $3000 restitution for crime I didnt commit. Can I hire another attorney to fight this?

Girl used my name & address to buy wig on a stolen credit card. I have text from her stating it was her. I was never shown any so called proof against me. My lawyer never told me any info or advice. Never asked for proof from me. If I offered he shrugged off. I dont think he fought for me at all. I was just an easy $3500 for him. I was offered 5 yrs probation & pay $3000 restitution. Can I hire another attorney to fight this.

A: You can always hire another attorney to fight for you if you can afford to.

The question is, did you already plea? If so, it is very difficult to set aside the plea.

If you have not accepted the plea, you simply have to find an attorney you feel confident can do a better job. Problem is, until an attorney sees the discovery and what evidence the prosecution as supporting their claim, and the admission you have from other person that she did it, they can't what they think of your case.

If you have not pled, before I spend money on another attorney, I would sit down with the attorney and ask them why they do not believe you should go to trial and subpoena the other person who did it to court, and use the email or message admitting they did it, to impeach her if she denies it. Make a list of questions you have for them before the appointment so you don't forget to ask them.
