Q: Can a pro se or attorney file a contempt of court complaint against attorney and tenant for not obeying order and decree

On 3/21/18 a court order and decree gave tenant until 6/22/18 to vacate the property and municipality that date to remove tenant.

Instead tenant refused to move and municipality refused to evict after that date, Municipality instead, without contacting court, on 8/1/2018,

rented condemned structure in open ended 700 dollar a month lease agreement to previous tenant. Has tenant and attorney committed contempt of court?

A: Not sure what the Municipality or yourself has to do with it. Are you wanting the Condemnation of your own property? I assume you are the landowner and filed a Detainer Warrant. It appears you should have hired an attorney and got a Writ of Possession executed. Now nine months later are you accepting rent? I suggest you hire an attorney to properly prosecute a Detainer Warrant to fruition. Contempt should not be an issue, which would not help you anyway. It is possible you do not understand what has occurred, and should now try to charge the possessor with Trespass. Do not go past three years.
