Q: Can my new landlord force me to use their pet addendum instead of the one I signed with the previous owners?
New landlord purchased my property just after I signed my (current) lease with the old landlord. New landlord has different pet addendum which is 3x more expensive. Since the new landlord took over, I adopted an additional pet (already had 1, and had signed the pet addendum with old landlord). Can the new landlord force me sign their pet addendum and pay their pet fees, or may I use the same addendum I signed in my current lease? If the former, should I be able to roll the pet fees I already paid (to the old landlord) into these new fees? New landlord said no, but I feel like they are forcing me to change part of my lease, a part that swayed my decision to live here in the first place and not what I had originally agreed to when I moved in. I cannot leave due to having signed a 15 month lease, I feel as though I'm being taken advantage of. If the later (being able to use the pet addendum I already signed), how do I go about telling my new landlord I will not be signing their addendum?
A: If you are amending your pet addendum by adding an additional pet then you likely will have to convert to the new owners form. But, if you are not amending then the original addendum is binding on the new owner. If you are having trouble getting beyond this issue you should consider having an attorney draft a demand letter to your landlord stating your rights.
