Los Angeles, CA asked in Civil Rights for California

Q: I’ve been falsely accused by them before. Now they are filing harassment and restriction order at court. I need advice

We Are both girls. She falsely accused me of sexual harassment at work. I was cleared from HR. She has now taken me to court for harassment and a want for a restriction order. I haven’t spoken to her since our last convo on March through text. I asked her a question and told her “Sorry my PTSD makes me irritated at times”She put many lies on her statement for court. She put that im aggressive and is falsely accusing me of trying to run her and two other co workers over. They are lying which is purjury. May i tell the judge to look at the cameras at my work place ? It worries me that she will claim that because of my PTSD that I’m an irritated angry person at random times. How can I defend myself towards that .That isn’t the case , I’m super shy, reserved, and calm by nature. She has lies I can prove to the judge . How can those lies get her into trouble ? She is starting to scare me . She won’t leave me alone. I want her away from me and my family.

A: Get the response papers from the website: copy and paste this into your browser http://www.courts.ca.gov/forms.htm

and from the pull down menu click on Civil Harassment Protection and then scroll down to form CH-120-INFO which will explain how to fill our the response form (CH-120) and how to gather your evidence so you can present it in court at the time of the hearing. If you need more time, fill out and file form CH-115 to request a continuance of the hearing date. Most of the information you will need you can find at the court forms page I've referred to above.

You will need to subpoena the videos, or have the custodian of records for your employer bring them to court for the hearing. Make sure you obtain the videos yourself, directly from your employer, well in advance of the court hearing date, and view them to make sure they are helpful to your case. You can then bring them to court with you and present them to the judge at the hearing.

You should contact a local attorney or lawyer's referral service, or go to the Los Angeles County Bar Association (https://www.lacba.org/) and get some help from them. They will have services to assist you.
