Asked in Municipal Law

Q: I tripped and broke a rib on a pathway that had a two inch crack down the center in a city park. I have witness and pics

Is it worth it to do a law suit for this unkept trail that has since been fixed

A: Maybe the best way to help you make your decision is to have a quick consult with an attorney in your jurisdiction. I don't know what state you are located in, but in general, cities/municipalities can be determined defendants in defending injury suits. Gather your witness testimony, photos, and medical records and try to arrange a quick free consult with an attorney without delay. If nothing else, you should find out about notice of claim requirements and abbreviated statutes of limitations for the city/municipality where this took place, if they are applicable. That means your case could possibly be governed by short timelines (some in the order of days, depending on the jurisdiction) that require a quick action as to what you need to do next if you decide to move forward with legal action for your injuries.
