Dallas, TX asked in Family Law for Louisiana

Q: If I am divorced, and looking to move in with my new boyfriend, can my two kids (age:14&8) be taken away from me?

Wanting to move in with my Boyfriend who is great to me and my kids. We have been dating a year now. My kids may get mad at me for moving them away from there friends and I am scared they are going to say they want to move in with the grandparents or the father. I have sole custody and they may not understand it now, but this is what's truly best for them. My ex husband is a gambler and gambled all of our equity from our home, and our life savings. I feel it'll be best for us to move in my boyfriends home. We have talked about it a great deal, and he has plenty of space for us and there are many nursing job opportunities for me where he lives. Thoughts?

A: Consult with a custody lawyer because the distance depends on:1) how far you are moving, 2) whether there is a judgment prohibiting overnight guests, 3) whether the boy friend has a record.

A: One of the things a judge looks at is stability of the relationship. If you move in with a boyfriend, the question most judges ask is where will you go if he makes you move out. Perhaps a bigger question is, if you've been dating for a year, why would you not get married rather than simply move in with him?
