Q: How to Sue a business based out of Memphis. Thank you in advance! I am struggling to find procedures in Shelby co.

I entered into a buy sell agreement with a "technology company" named Whiskey Creek. Their address is based on Memphis. I live in Louisiana. The buy sell was for a website/business methods that generated revenue using Google adsense, I paid $35,000 based on his valuation and doing some research. He claimed profit of about $2500-$3000 a month. The training was horrible and the methods were hard to follow. Despite this I was able to get it implemented after about 2 months of email "support". I was able to generate $45,000 in revenue but due to a tax screw up and Google cancelling my account I actually lost about $1000 from November 9th 2018 - March 22nd 2019. With Google banning my website for "unoriginal content" It is now completely useless so I am out over $35000. I am willing to take a loss to get my money back in Small claims (which I know if a $25000 limit). Any advice on how to proceed? I have TONS of email evidence. I have been on shelby co. website, but struggling to figure it

A: If you want to stay at the $25,000 or under limit you initiate a lawsuit in the general sessions court by filing a civil warrant. Shelby County has forms you can fill out and file with the clerk's office. You would then serve the business, typically through its registered agent. If you want to go with an amount higher than $25,000 then you could choose to file in circuit court. There are no forms and you have to draft a complaint yourself. You could do both options on your own, but the business would be required to get an attorney which would put you at a disadvantage. For the best results, you should consult and hire counsel to assist you.
