Middletown, NY asked in Medical Malpractice for New York

Q: My daughter was sick a while ago and was not diagnosed properly they failed to call me to tell me she had strep.

my daughter started getting pain in her joints and they ran some test and her blood levels were extremely high, that's when they discovered she went untreated with strep. she has gone through a lot of changes, from being in constant pain in her joint, legs, the heel of her foot, chest pains, headaches, she was put on antibiotic's for a year, she is still going through pain they ran more test her levels where still high they gave her stronger medications which now has affected her stomach, she's had to get an endoscopy and colonoscopy at the age of 9. she had to see cardiologist because strep can cause damage to the heart. what can I do? can I sue for mal practice? my daughter is still suffering from stomach pains and joint pains. if they called me to tell she had strep all this could have been avoided and my little girl would be okay. she was always a healthy child besides having asthma and seasonal allergies. can someone please advise me on what I can do.

A: I'm sorry for the ordeal your daughter and your family have gone through here. As a first step, you could set up a consultation with a med mal attorney in New York. Most law firms in the med mal area work on a contingency basis, and many offer free consultations. Attorneys could obtain your daughter's medical records and thoroughly examine them in terms of the failure to diagnose cause of action you touch upon here. You mention many symptoms that a firm could investigate further with the expertise of medical professionals to determine if the basis for a viable case exists. Good luck.
