Q: how to find out if the custody agreement is legal that i signed but never took in front of a judge.

I was told by the lawyer it was not legal or binding until both me and my sons father went before a judge with the agreement. I have not had primary custody of my son for 2 years since this and I have found out that the lawyer of my child's father has been disbarred for forgery. Apparently she was signing the judge's name on a lot of documents and now can not practice law anymore. I thought the signing of the papers in her office after dark and not getting a copy of them, EVER was a little strange. But my child's father and his mom will not let me have my son just whenever i want to now. They let me pick him up every other weekend as if according to KY state law. Who can tell me if the papers that were signed that night were forged or legal? Please help me. I would love to get my son back. I have already missed out on so much.

A: First, you’ll need a copy of the papers signed. Second, you’ll need to determine who signed them. Third, you should check the circuit clerks office in that county and see if the were filed and signed by judge in court. If they were, it is enforceable. If not, or if they were forged, it is not enforceable and you may need to file a new custody action to establish parenting time with your son.
