Q: I had a slip and trip claim resulting in a broken wrist - I believe the club to have produced fake accident reports

I had a slip and trip injury in December in a club which resulted in me breaking my wrist.

The solicitors I went to for my claim, have dropped my claim as the club produced an accident report showing the wet floor I slipped on had been cleared and there was a wet floor sign out before my trip.

I initially told them my trip happened at about 2 o'clock , but now looking back at photos I can see I left the club by 1.

Also I can see the cleaning report is timed at 2.13, and the club recorded my accident at 2.45 approx - but my trip happened at about 12.45. The solicitors have said as the defendants have proved they had a cleaning procedure in place that night I can't claim. But surely if the floor was wet with no sign I can still go ahead? ( I watched the club bring a wet floor sign out after I fell, but I can't prove this and they're denying it)

I asked them to check CCTV straight away and the club don't have footage of that night...

A: This is a tough case. From some of the terminology you use, I'm not sure if this took place in the United Kingdom, but some of the underlying general legal principles would likely be similar to U.S. law in this type of tort case. It's possible the original solicitors felt that it would have been costly to attempt to refute the club's report with the wet floor sign through deposition or having an investigator identify and interview witnesses. One option you have is to consult with another solicitor. Good luck
