Phoenix, AZ asked in Criminal Law, Family Law and Constitutional Law for California

Q: Can a police officer take me to jail For calling them for to come help me?

My x spouse was out of state without my knowledge. My 15 wouldn’t answer my calls or texts, I went to my home to check on her, I found hard liquor empty bottles and passed out teens through out my home, she was locked in the master I opened to find her in underwear and a guy...she was cursing me out and no one would leave when I asked, I called for assistance from the PD. They showed up & said they couldn’t do anything about her having a underage party& asked to see my family law papers, when I said I didn’t have what they asked for, the peaceful contact order, the cuffed me put me on cop car searched me and my car, purse and found my bottle of random vitamins hormones and 1 left over pill from a third degree burn that I had on my hand 2 months prior that I had to go to a burn unit at UC Davis to have treated, I have proof. I was hauled off to jail for violating a peaceful contact order at my home trying to protect my home & daughter, also charged with having a controlled substance.

A: More info needed.

i doubt if they will file against you and if they do your lawyer will probably get it dismissed.

either hire a lawyer now or ask for a public defender if you have to go to court.

maybe consider writing out a summary now while everything is fresh in your mind.

your memory is better now than it will be in 6 months.
