Q: Am I responsible for an accident broken window in a parking lot

Hi I was in the mall parking lot and somehow kicked a rock and broke the back window of a Chevy equinox that was 5 feet away , the rear window shattered outwards .. I now read this is common due to heat ... I waited around and talked to the owners and now they went to the cops and want me to pay does this fall under the same law as when a rock breaks your window on the highway ? A: When you say you kicked a rock--do you mean your car kicked it out or you kicked it with your foot? If you did, it's not a "somehow" --that's going to be believable, because you would have had to be winding up to get enough velocity to break a window.

Windows don't shatter due to heat except in fires and other extreme circumstances.

If it was a car, you would claim it's not your fault but turn it in to your insurance.
