Los Angeles, CA asked in Domestic Violence for California

Q: What will help get a domestic violence case dismissed and the person not be charge with anything?

Me and my girlfriend got into a fight. The cops were called and statements were taken from both of us. I was not aware I could deny the police taking pictures of me. There were marks and I didn’t know I could say it was verbal between friends so neither of us would go to jail. That’s what she said so I wouldn’t get in trouble. What can I do to get this case dismissed on my end, she’s only 20 with plans for her future and if she gets this felony her schooling and wanting to be a cop will be ruined and she does not deserve that. It was really a misunderstanding. What can I do to help get this case dismissed? I heard not showing up to court and writing a letter would help. But I’m completely clueless. This is my first time experiencing something like this.

A: Every case is unique and more information is needed to properly answer your query intelligently.

Initially, you should not be discussing it on a forum like this. It is too easy for a police investigator to see it and come to the wrong conclusion...that could hurt both of you.

However, it is always a good idea to contact a local attorney that handles these types of DV cases in the court most proximate to where you would have to appear.

In other words, I am in Palm Springs and you don’t want to hire a Palm Springs lawyer for an Orange Co case. In those cases I usually try to refer the potential client to a lawyer that is closer to where this happened.

Most Criminal lawyers will offer a free consultation to review the facts. For other areas of law, many lawyers will bill for a consultation.

For a criminal case, success may depend on how the evidence was obtained and the details regarding the stop and arrest as well as a review of the facts of your case.

Call a local attorney to discuss in more detail and request an appointment.
