Q: Can i sue a builder for overcharging us? We bought a house in Texas 77007 area in july 2018.

Can i sue a builder for overcharging us? We bought a house in Texas 77007 area in july 2018 and now the builder is selling 3 exact same homes like ours for $50000 less. Also we had a downtown view that is now completely blocked by new apartments. The builder did not disclose this information at the time of selling. The hoa was raised more than 15% without a notice. Also certain items from closing inspection is not taken care of like window screens, we also have a water leak issue that came up on our 10month inspection.

A: I hesitate to say it but you have too much invested to not speak to a lawyer in the county where you have the house. You would be hard pressed to recover anything because the seller reduced the price, unless you can establish some type of fraud. The blocked view is not as rare as you may think, particularly along the beach. Again I doubt you could recover for that unless you had also purchase "air rights" or had been promised the view would not be obscured. Other issues are: (1) did the builder know that apartments were going to be built to obscure your view? (2) did you have reason to believe the view would remain (3) why did the price fall on the houses (location, location, location). So there are too many variables to your question--best to speak with a tort (personal injury or contract) lawyer. Best of luck to you.
