Q: If we were/still together can he still get stuck with child support because I had medicaid? He's paid/supported him

We did live together but had separate homes as well. I just couldn't afford to have the baby with no insurance. Father has paid for his insurance since 6months old, he's over a year now

A: If a child receives certain types of public assistance, such as Medicaid, it triggers the State to bring an action for the other parent to pay child support. Depending on the type of public assistance being received and to some extent the specific county you are in (and thus judge assigned in your county), you may be able to waive child support if both parents are in agreement. If the child is receiving Medicaid, the Court may order the parent to pay cash medical support which is a monthly amount that goes back to the State when the child is receiving Medicaid in the other parent's public assistance household. If there is no longer any public assistance, you may be able to ask the Child Support office to close your case. A parent can also be ordered to pay a medical reimbursement for birth-related expenses that goes back to the State to help recuperate the costs paid by Medicaid for the child's birth. If you want to see what your options are for waiving child support in your case, you should contact your local child support office and talk to the caseworker assigned to your case.
