Q: With description what rights and options are available? Home was purchased with money deeply sentimental to me...
Paid rent to my mom sharing her home (also child), oral agreement, she, on whim changed;living arrangements, unrealistic expectations, cash only payments, refused receipt, which she would constantly manipulate, pleas for more money because she can’t pay bills/mortgage, then acting as though monies were never exchanged... My child’s father came to stay, after over a year, with agreed separate rent to be paid. Soon told us she was going to live with her S.O., and quickly demanded more money (we were already paying $300 over her mortgage/insurance/water) to go toward further utilities... I asked for any written lease/evidence of billing amounts and needed proof for childcare assistance renewal, to which she refused.
Then had to (several times) pay $2-300 to avoid utility shut off of bills she still neglected to pay. I saw these payments as rent applicable, with stated terms, but she has completely disregarded.
Lost childcare, now she is seeking eviction
Harassed in many ways...
A: If you do not have a written lease, then if an eviction action is filed, the court will likely evict you. All that other past history is irrelevant. If the court orders the eviction, it typically gives tenant only 7 days to vacate. So try to work it our, or look for new living accommodations.
