A: I am sorry for your loss, however you haven't said what you would like to know. If your dog was loose, you may have a claim made against you for damage to the vehicle, and may wish to notify your homeowners. Your state is not identified. If your question is do you have a claim, you would have to show that the car driver was somehow careless verging on intentional, and would then have to show that any trauma resulted not only in requiring treatment by a psychologist or psychiatrist, but in many states that there was physical fallout from the incident. This is a very complicated and difficult hurdle, especially as many states do not recognize recovery for death of an animal. Some courts have found that all the person can recover, at best, is the market value of the animal not the value of any emotional attachment.

Your most direct way to find out the law in your state is to contact a member of your state's Association for Justice or Trial Lawyers Association--they give free consultations.
