Q: Recently purchased home and sellers have 30 day out clause. Can we inspect the home or have keys provided to us legally

Initially they told us they would not need the full 30 days despite in the purchase agreement, but now are showing signs that they may stay longer. We closed on the home nearly 2 weeks ago. They forced an insurance inspector off of the property who was there to take pictures for our home insurance policy of the exterior of the house. Also have acted erratically. We're concerned about what they could be doing to our house. We did not get keys at close and were told we could not have them until full possession. We're considering asking (perhaps demanding) a key. Also considering treating them like tenants and insisting on an inspection via giving them 24 hours notice, etc. What can we do? Thank you

A: What you can do depends a lot on what your purchase agreement says. You DID have an attorney review that agreement before you submitted it, right? What does that attorney say? If you didn't have an attorney review it before hand, it is way past time to have an attorney look at it now.

MOST agreements essentially create a short term tenancy where the seller becomes a tenant. That does not mean you can enter the place whenever you want -- it means you are bound by landlord/tenant law and need to act accordingly.

PLEASE seek local legal advice from a licensed attorney. It is not too late to start protecting yourself even if the results won't be as perfect as they would be had things been done up front.
