A: Your question is a little unclear. It is possible for the parties to dismiss their custody action if the parties have decided to pursue an uncontested adoption action instead. It is generally the custodial parent and their spouse that files the adoption action. The biological parent that wants to relinquish their parental rights would cooperate with signing the necessary documents to voluntarily relinquish their parental rights so that the adoption can occur. When the biological parent's parental rights are terminated and the child adopted, then the biological parent would no longer have visitation/parenting time rights and would also no longer have a duty to pay child support.
