Round Lake, IL asked in Criminal Law for Illinois

Q: can I sue a county for not fully investigating a case and wrongful prosecution? I have plenty of evidence.

I have evidence that my brother and nephew were lured over to a place so that the young man could purposely try to kill my nephew. The officers involved went off of word of mouth and did not fully investigate the situation. They did not question the neighbors or try to find any witnesses. They let the young men that attacked my family go claiming self defense without fully investigating the situation. My brother in custody has self defense wounds from trying to stop the boy from stabbing my nephew. My nephew was severely injured and had to be airlifted to another hospital fighting for his life. They are trying to prosecute my brother with a class 4 mob action felony and when my nephew is healed they are going to try to do the same thing with him. I have hard copy evidence that this was a premeditated. I feel that the county or officers involved should be sued or investigated and my family should not be charged with anything. Once again I have evidence.

A: The focus right now should be on gaining his acquittal. You should share your information with his attorney.

If he is convicted there is no civil case.

And he is the only one who has standing to sue
