Q: If an address is written incorrectly on a citation can the ticket be dismissed??

I received a speeding ticket in Burgaw. I accelerated to pass the car in front of me. Police was right there on route 40. The address on the citation

is incorrect. Since the trooper said I was going 85 in a 70 zone it is mandatory that I appear in court. I live out of state and am a caretaker for my

grandchild and cannot appear.

A: Can it be dismissed - sure, but the real question is whether it is likely to be dismissed and the answer to that is - no. The DA has the authority to amend and correct errors on the citation and they will likely do so especially for a simple administrative error such as an incorrect address. As to the other information you submitted, you are not allowed to exceed the speed limit in order to pass. So the fact the you were passing another car is irrelevant. Unless you hire a traffic attorney, it is mandatory that you appearin Court. The Court will not care that you believe you cannot appear. If you do not hire an attorney or appear, NCDMV will suspend your privilege to drive in NC and will notify your home state who will in turn likely suspend your license there as well. Plus the Court will tack on an additional $200 penalty for good measure and both DMV's will likely hit you with reinstatement fees. Your best bet is to just hire a traffic attorney and have them handle this for you so that you do not need to appear in Court and the ticket does not affect your license or insurance.
