Q: Termination of CS withholding order at age of majority (19) in Jefferson County, Alabama.

My withholding order was set back in 2008 in Talladega County, where we originally filed our divorce. With my ex and I both living in Jefferson County, it was transferred there, and they have handled everything since. I have spoken with multiple people with Jefferson Co. DHR, they told me that all I had to do, was to let them know when my child turns 19 and that they would put in the stop order. They told me that this was all I needed to do. I have done this, and they told me it was now done. This was only a week ago, but I just feel like it was, almost too easy. Is it because the original order stated that CS would end on her 19th birthday or graduation from high school whichever occurred latest? Should I expect to have to file the 2 forms? (as Kristine Jones stated in response to another question) I had originally planned to file the forms but after speaking with DHR, I haven't, since they said I didn't need to.

A: Hello. If DHR did what they told you they did, the motion is on file with the clerk. If you did not get a copy of DHR's filing, then you can get one from the clerk. You should also monitor your case so you can get a copy of the Judge's order when it comes out. Once the order comes out, you will have official documentation of being released from your child support obligation. The court may also mail you a copy of the motion that was filed, but no guarantees and you would do well to check on your case yourself with the clerk. Best of luck!
