Q: What constitutes removal of grandparents rights as joint managing conservator with a fit mother?

I am needing to know if I have a case or not. I have gotten different answers from different attorneys. My son’s grandparents sued me for visitation when their son died. My son was 3 and is now 10. They alienate my parenting with undermining and play “good cop, bad cop” so my rules don’t apply when my child is in their care. They don’t help him study like I’ve asked so he does poor on tests after being with them. They buy him dangerous weapons after I’ve asked them not to. They send him off with random people when they are supposed to have him without notifying me. I’ve tried to correct this but I get no response or “the order doesn’t say we have to ask you.”

I have two other children and I am going to nursing school so I’m also looking to lift the geo restriction as I have a better support system outside of the restriction with a higher income to be made. Should I dish out the thousands of dollars to go back to court or am I stuck dealing with this for the next 8 years?

A: Maybe.

You're asking two questions, first about grandparent visitation and second about lifting the Geo Restriction.

You probably have a good shot at the first.

I would need a whole lot more information to give you an opinion about the second. Where are you now? where do you want to move to? What does the judge of your court think about lifting restrictions in general? who is the opposing counsel? How much more money would you make? Are you wanting to move to live with someone you met online? What does your son think about the two issues? etc. etc. etc.
