Gray, GA asked in Divorce for Georgia

Q: Divorce question for a stay at home mom of 4 been married for 12 years. We have been caring for MIL for last 2 years.

My husband doesn’t have a paying job we just care for his mother. She mortgaged a home for us and bought us cars for caring for her. 6mo ago she moved into assisted living and now my husband doesn’t work and neither does our marriage. He wants me to move out and go back to my parents house and unenroll the kids from school which isn’t very fair to them in the middle of the year. So since nothing is in our names and naturally his mom sides with him, what are my options? I haven’t been allowed to work to help supplement income so I have nothing to currently fall back on but I am searching for a job. Can he kick us out? I mean he already sold my paid for car and now I have no car for the kids. He said he had to put the money back in her account. Do I have any other options other than to uproot my children in the middle of the year? He’s not agreeing to meet in the middle at all.

A: You need to consult with a family law attorney immediately. He cannot kick you out of the house. An attorney can help you file for an emergency hearing so he can pay you some support and provide a car to you.

A: No, he cannot kick you out. You should consult with an attorney right away who can help you with this. You do have options, but you need to consult with an attorney who can review the facts of your case in detail in order to explain what your options are and help you plan the proper course of action. -Homer P.
