Asked in Criminal Law, Family Law and Child Custody

Q: It was me again attorney. I just want to clarify things. So you mean attorney.

I don’t have the right to file a case against the father who lack of medical care to his child that may lead to cause of death.

I am the Tita of that child. I care for the welfare of the baby since there mother is my sister and died during giving birth of that baby. And now that baby died due to lack of medical care and the father knows that it was premature but he never dare to have a check-up for his baby that may lead to his cause of death.

I also want to file a custody for his child because I don’t want to lose another life again. (Buyag-buyag) Is it possible to ask custody for his child?

A: So if an attorney on her states there is no suit, are you then going to stop your effort because some faceless lawyer rejected your idea?

If a lawyer on here states there is a suit, then are you going to contact a lawyer directly and individually in your jurisdiction to determine if the lawyer will accept the case?

I think he either way you will consult a lawyer in the lawyer;'s office to discuss the possibility of a case and the costs. So isn't that what you should now be doing?
