Mandeville, LA asked in Family Law for Louisiana

Q: Barring a court order, is it legal for a father to come from out of state and relocate kids to another state?

The parents have never been to court over custody of kids, besides child support almost ten years ago. After being released from prison in LA, the father moved to IN. The mother has been primary caretaker since the kids were born. The mother had to go out of state for work last year and left the kids in the care of the paternal grandmother with provisional custody to enroll kids in school. The grandmother understood this was temporary and the mother was returning for kids. This past July the father came down to LA to move the kids to IN without notifying the mother of his intent to relocate the kids. Furthermore he did not only fail to notify her bc he knew she would object but also failed to file a motion to relocate the kids in accordance with LA family law (R. S. 9:355.6). What are the mothers options in filing a petition for the rulevto establish custody by a parent?

A: 1) Hire a custody lawyer,

2) who can prepare an objection to relocation,

3) who can also prepare a Petition for Ex Parte Custody, Custody, and Child Support.

Hurry you only have 30 days for some of this after the kids are relocated.
