El Sobrante, CA asked in Employment Law and Workers' Compensation for California

Q: if i have a work related injury and i settled my injury through a workers compensation lawyer can i open another one?

opening another case that is not workers compensation related. The injury i sustained was a injury to my left hand when heavy box slammed down on my hand and left a knot between my wrist/lower thumb area in february 2017. When seen by 3 - 4 physical therapist i was diagnosed with chronic pain syndrome. Due to the fact my injury still exist and is still painful i went and had a nerve damage test that stated i have a pinched nerve in my wrist that continues to be in much pain.Due to the fact i settled my claim because there was no use in continuing to see various therapist because there was nothing else to be done. Now im still unemployed with a injury that will continue to result in everyday pain being misdiagnosed could have been fixed if one or all doctors would have known i had nerve damage instead of chronic pain syndrome, What can I do to get my hand back so im able to work without such pain ? My pain has also exceeded to my right hand which is over used because of my left hand.

A: You need to immediately go back to the workers compensation attorney you used to file your initial claim and speak to him or her about your condition. You cannot simply file a new workers compensation claim arising out of the same injury, nor can you file a claim against your employer outside of the workers compensation process.

Good luck to you.
