Q: NOT AT FAULT Accident other policy was expired at the time and my car got totaled, Can I ask for monetary loss?

My vehicle was a lease and my insurance only covered (GAP) Other Party Insurance Premium was over and I would like to know If I can ask the other insurance for the loss of payments towards my vehicle, Payments made towards my car balance?

A: No, you are entitled to the fair market value of your vehicle, and "loss of use" which is generally measure by the daily rental value for a reasonable number of days after the collision.

A: you won't be able to sue and deal with an insurance co.......you will have to file in small claims as no lawyer will take this on a contingency....but good luck collecting........unless the driver is wealthy.

another issue is if you did not have liability coverage you can not collect for pain and suffering.
