Grants Pass, OR asked in Criminal Law and Domestic Violence for California

Q: Can a defendant in criminal case revoke plea agreement after finding PD was negligent in communications that are crucial

Victim (defendants wife) came forward and wanted to give a sworn statement to courts on defendants behalf because she over-reacted based on her PTSD issues from prior ongoing DV in last marriage as well as other mitigating factors. Victim owned the instigation and escalation and wanted the courts to know this incident shouldn't be placed on defendants shoulders. His actions were to put space between them, not cause harm. Victim had taken it out of control and showed up to relay her remorse to the courts. Investigator was called &was liaison between victim and PD, yet when info was passed on to Public defender, victim was in close proximity and could hear details withheld these pertinent details that defendant learned of later after plea was made. Additionally PD didn't volunteer the information regarding a court order signed by presiding judge about allowing for other judges to grant 7 day continuances due to an extended PG&E power outage throughout the county.
