Q: Can an ins company take $$ out of my settlement check for auto yard when their insured is at fault?

i was in a car accident that was not my fault. My car was taken to a tow yard. The ins company was supposed to pick the car up to take it to an auto body shop to be appraised but never did and my car was sold at auction. Now the insurance company said they are going to take the amount of $$ for the storage out of the settlement check they cut me. Is that legal??

i suspect there is a dispute over the taking of the car to a body shop and they are saying the delay was your negligence not theirs.
