Q: How would I properly evict an ex from my home?

Being my former significant other, she has lived with me for about 3 years without any expected rent or written agreement. In the early summer this year when we broke up, she said she would be out by the end of the summer, and I agreed to wait. As time went on I communicated at the beginning of September that I wanted her out by the end of October, but she still remains. Do I need to find a proper eviction document to produce to her and wait another 30 days? Additionally, I've known her to have suicidal thoughts at times, is there anything I should do if faced with that type of retaliation, or even before starting the eviction process that will certainly be stressful?

A: You must follow the proper eviction process to force her out, or she could sue you for wrongful eviction. Without a written lease, she is a month to month tenant. Either tenant or landlord can terminate a month to month lease at the end of any month by giving 30 days written notice of the termination. Notice given in November would be effective Dec. 31. If the tenant does not vacate by then, landlord gives a final written notice, and then files an eviction complaint 3 days later. Check your local court web site for the notice forms and eviction process. If she makes threats to harm herself or you, call 911 or the police.
