Brooklyn, NY asked in Immigration Law for New York

Q: Can moving my case to USA embassy in my home country solve my problem?

I am in the USA under TPS status for El Salvador. My current employer is sponsoring me for adjustment of status. Everything was approved, and I recently went to my interview. I received a letter where my green card was denied because I failed to maintain legal status for about 6 months. I was brought here illegally when I was 12 years old, and six months later I got approved for TPS. I have advance parole and traveled on July of this year to come back legally, but the letter says it doesn't override my first entry. My current lawyer is suggesting to move my case to El Salvador and wait for the green card there. I was denied already, I don't want to go back there and be denied again and worse be banned from entering the USA. I lived all my life here, no crimes, paid all my taxes and never worked illegally because I had my work permit since I was 12 years old ( six months after I arrived illegally no inspection) I don't know what I should do...

A: Your situation requires an in person consultation with an experienced immigration and more information. Whether or not your attorney is correct or not cannot be determined any other way.

A: Consult with an immigration attorney. In some circumstances TPS amounts to a lawful entry.
