A: How can someone fight another person who is not near them? A fight is defined as a physical altercation thus requiring that they be in close proximity. It is possible that they could be arrested for making criminal threats (PC 422) such as threatening to come over and beat them up...

A second issue is whether a 17 year old would go to jail. For this type of incident, the answer is no since 17 year olds are dealt with in Juvenile Court. Juveniles can either be taken into custody at Juvenile Hall or Camp but not jail. Most common would be a HOP (Home on Probation) sentence if there was an actual brawl but no serious injuries.

More facts are necessary to give a more accurate answer. You can make an appointment with an experienced criminal defense attorney who handles juvenile cases as they are a different animal than adult criminal cases. Most of us offer free initial consultations. If you can't afford a private attorney, the Court will appoint the Public Defender or a Panel Attorney for you.

Good luck!
