Santa Ana, CA asked in Employment Law and Employment Discrimination for California

Q: I was recently fired under a bogus statement that was emailed to me. I have screenshots of the emailed conversation.

If you have the option for uploading screenshots you can see everything. I worked for Tidy. They are a online company that books cleanings for homes. I was lied to and let go under false statement.

A: This is not a lawyer recruitment site. We offer advice to those who seek it here. If you are searching for an attorney who handles wrongful termination cases, you might go to the website for the California Employment Lawyers Association (CELA), or you can go to the Orange County Bar Association's website and look for their Lawyer Referral Service. They should have an extensive list of attorneys who can assist you with a wrongful termination case.

A: You have not asked a question. If you want to know if you have been terminated wrongfully, the answer is legally no. You are considered to be an at will employee unless you had an agreement to the contrary with your employer. As such you could have been terminated for any reason or even no reason at all. Your employer could rely on any information it wants to terminate you, even information that you can prove to have been false. Your employer did not have to have any evidence of wrongdoing. Your employer did not even have a legal duty to tell you the truth.

Unless you can prove this happened to you because you are a member of a protected class of people, you likely have no recourse.

If you posted here hoping an attorney would respond by agreeing to work with you, this is not the place for that. At this point, if you think you have a legal claim you should locate and consult with an experienced employment law attorney as soon as possible to explore your facts and determine your options. I would suggest you look either on this site, or go to www.cela.org, the home page for the California Employment Lawyers Association, an organization whose members are dedicated to the representation of employees against their employers.

Most employment attorneys who practice this area of law offer a free or low cost consultation in the beginning and then, if the matter has merit and value, will usually agree to work on a contingency basis, meaning you can hire an attorney without paying any money until the matter results in a positive outcome for you. Many advance all the costs of the litigation as well. Do not let fear of fees and costs keep you from finding a good attorney.

Good luck to you.
