Q: I wanted to see what my options were for filing abandonment against my husband who has been gone 3 years?

I wanted to see what my options were for filing abandonment against my husband who has been gone and not living with my disabled son, his disabled brother who lives with me and myself. He has been gone for almost 3 years now. It will be 3 years in March. He does not come see them, does not help with things they need, gets his brothers social security check in his name and quite a few other things. I try to get him to see the kids, his excuse is he is always working or he has to work that weekend or he cant take care of his brother. He is broke and many more. When he can buy a new car everytime I turn around. He says he works 3 jobs but still does not help. He tells my son that he will come see him then not show up and if he does show up he only stays for 2 hours at most.

A: You will either have to get him to agree to an Irreconcilable Divorce, or establish grounds. Abandonment is not even close here. There may be some leverage you can assert, so talk to a competent attorney.
