Corona, CA asked in Personal Injury and Landlord - Tenant for California

Q: Can I file a lawsuit against an apartment complex for not allowing me to extend me lease due to a medical surgery?

Had neck surgery 11/8/2019. Lease ended 11/15/2019. Asked to extended lease do to surgery prior to surgery. Apartment co manager said no, as someone was moving in.

I was not in a lot of pain prior to move out and after surgery. Asked one more time after surgery to stay and same answer, my apartment was rented, so no. 11/14 night I was moving out spoke to other manager in regards to turning in keys and was in major pain no. She stated the complex could of made other arrangements and allowed me to stay after surgery. Since then, physically going through hell and complex charged me 800 for move out fees such as repainting, and overcharging for days I already paid.

A: more info needed.

things would be controlled by your contract ie lease.

did you move voluntarily? did they file UD?

i would contact a local lawyer to see if they would take the case. If not consider small claims.

this may fall within ADA (Americans with disability act)
