Visalia, CA asked in Personal Injury for California

Q: I want to know if I have a case or not, I slipped & fell in Walmart because of something that was spilled on the floor.

A Wal-Mart manager made a report on the fall & they took pictures of the spill & there was a video of the fall. Wal-Mart gave me a claim number. I've been seeing a doctor for pain in back & I'm on medication. They have taken xrays & now ordered a MRI but I have to wait for Medical to approve it.

A: It sounds like you have a case. We have many cases like yours. Do you happen to know what it was that you slipped on? You should contact a personal injury attorney and discuss your case right away. Wal-Mart along with most defendant's don't want to pay you anything if they can get away with it. You really need an attorney on your side protecting your rights. Good luck to you and call an attorney right away.

A: It depends on whether Walmart was at fault. Did its employees spill the liquid? If a customer made the mess, was the liquid there long enough for Walmart to notice and clean it up? Facts matter. You should definitely consult with a PI attorney. You won't get anything reasonable, even if Walmart was at fault, on your own.

A: more info needed.

what did you slip on and how long was it there?

if a customer drinking a coke just got bumped into by another customer and you then slipped, it would be a problem. If you and your lawyer can prove it was there for a while then they were arguably negligent.

you want to see a lawyer right away and have him/her send an anti spoliation letter to preserve video.

they often record over it and then you have no video evidence.......act asap.

and be careful what you discuss on an open forum like this.
