Van Nuys, CA asked in Criminal Law and Domestic Violence for California

Q: My bf and my roommate fought on the freeway and I want to know the worst-case-scenario outcome for my bf.

I was not there. Bf drove my car. He and roomy argued. Roomy demanded to be let out, middle lane, many cars, going fast - request not yet possible. Roomy put car in park and turned off ignition, and doesn't let bf put it back on; bf flails and does what he can to try. Roomy pins bf's arms and neck. Bf panics, can't move, can't breathe, flails, bites Roomy's face. Finally initiates "tap out," Roomy calmly says "that's all I wanted" and slowly pulls away - not immediately letting go. Bf punches him in the face and gets out the car. Roomy jumps out and puts him in another headlock, explaining to passing cars that bf attacked him first and that's why he's headlocking him. Eventually they disengage. Police were called, but bf left to come get me before it was made clear to him. I went with him to file police report; Roomy filed police report to get his face injuries treated at hospital. Idk how this looks, legally. Bf doesn't have serious injuries; Roomy claims multiple blows to the face.

A: more info needed.

the case will be fact based..........what can they prove?

it sounds like self defense up until there was a cease fire and your boyfriend reinitiated the fight.

contact a criminal lawyer and write down the facts as they are fresh in his mind now but may not be in 6 months or more
