Asked in Immigration Law for New York

Q: Is there any other way?

Hi, So i in few months i am going to marry a girl i have been dating for a while now...she is a US citizen, i have filed for divorce for my previous spouse once it gets approved i will right away marry this girl, i have a child from the previous marriage who is above 18 years old right now (currently living in Australia). I am not a citizen of united states or LPR.

according to the law she can't petition her for step child because she is above 18 years old. Is there any other way her US citizen stepmom petition her?

Thanks

A: This is strictly an Immigration issue not family law.
