Q: My sons car was hit and totaled by an uninsured driver while it was parked. How does he get reimbursed for the car?

The driver was cited with failure to control and was found guilty. How does he get some kind of restitution for the lost of his car?

A: An Ohio attorney could advise best on this, but your post remains open for four weeks. At this point, you have probably discussed the matter with your insurance people and have learned about these routes. Some of the recourses you might have are to treat the property loss as a first-party claim if your policy includes such coverage. If your policy includes coverage for uninsured motorist protection for this this type of loss, that could be another option. Another option could be to present a claim to the other driver. In terms of restitution, I'm not certain if you use the word loosely as compensation - or you mean restitution in the form of a remedy for crime victims. If alcohol was not involved and the matter was not cited criminally, criminal restitution would not likely avail itself. That is something, depending on how the responding traffic officer cited the violations, you could discuss with an attorney familiar with criminal law if you mean restitution in the latter sense of the term.
