Q: Can an out of court witness statement be used at trial if the defendant has not had the opportunity to cross-examine?

medical statement was not at preliminary hearing to be cross-examined. can it be introduced later?

as a rule, the statement has to be validated..........thus the other party must have an opportunity to cross examine.......and confirm it was really by the person alleged to have made it.
