Portland, OR asked in Family Law for Oregon

Q: I have sole custody, can her dad sign any consent forms?

I found out he opened a bank acct, and put my daughter on it (if your under 18 a parent has to be attached to the minors acct) without my knowledge, so he could transfer her money without me knowing. Seems great contributing more to the child right? But he bought her clothes, then I also gave her money for the same items and she didnt tell me. Double dipping. I saw a transfer of $ to her account i didn’t recognize. I wanted to know if he can sign consent forms for her of any kind, even a bank account.

A: In theory, Dad can do what he wants with his money including giving your joint daughter money, absent some court order that says otherwise. It sounds like the real problem is how this might be a bad parenting idea, ie giving money to a minor if the minor is not mature enough to handle the money, or as your narrative suggests, it is causing the minor to be deceptive to milk both parents for money. It sounds like both you and the father should meet with a counselor and discuss how you can unite in your parenting plans for the sake of your daughter and the counselor can contribute what they know about children rearing and make suggestions as to how you can both provide for your daughter but also insure responsible financial skills are developing. It might be OK for dad to do something like this if there is better communication between the two of you. If dad is unwilling to participate voluntarily, then file a motion with he court to amend the parenting plan to set rules on how money is provided directly or indirectly to your child. This will force both of you to go to mediation and discuss this and if you don't resolve it there, a court will hold a hearing.
