Q: In CA, if I see a dog that I previously owned being neglected, what are the charges held against me if I take him?

I would like to take him back and give him the proper medical attention.

A: You can be criminally charged with Robbery (Penal Code section 211), or Larceny (Penal Code sections 484 & 487), depending on circumstances. You can also be sued for Trespass and Conversion, with an allegation of punitive damages. It's not your dog and you have no right to take him. If the dog is being mistreated, call Animal Control.

HOWEVER, MY FIRST TRIAL AS A PUBLIC DEFENDER WAS DOG NAPPING.

IT IS CLEARLY A THEFT...AND DEPENDING ON WHAT YOU DO TO ACQUIREE THE DOG MAY BE TRESPASS ETC..... AND REPORTING THE POOR TREATMENT TO ANIMAL CONTROL, WOULD BE A BETTER AVENUE.
