Dallas, TX asked in Family Law for Texas

Q: If my husband modify’s his child support, can his daughter’s mom ask the judge to change the days he gets her?

My husband wants to modify his child support and hoping it goes down due to us having 2 children together. At this moment we are currently busy and what works best for us is getting my step daughter every 2 weeks like he’s supposed to and like he’s been doing so. If he modify’s child support can his daughter’s mother request for us to have her more days and would the judge grant her request? We would really like to keep it at every 2 weeks.

A: She can't request the days be changed based on the child support amount. She can ask for the days to be changed based on other reasons. For example, she can say that the current visitation schedule is not in the child's best interest because she is always late and doesn't get her school work done while in the father's care. I am not saying this is happening, but just using this as an example.
