Q: My neighbors dogs are fence aggressive. They're breaking through the fence and the owners refuse to address it

My neighbors own 5 german shepherds. They are fence aggressive and are tearing holes in our fence. I have spoken with them several times and they refuse to address the problem. Police and animal control say they will not do anything until someone is attacked. All complaints have been recorded for the last 2 years. I have video of the behavior. Reports have been made to GJ Police, Mesa County Sheriff's and Mesa County Animal Control. They're aggressive, left alone outside year round, and have been reported by their vet to be dangerous. The vet will not admit them unless they are muzzled and sedated. The owners daughter refuses to bring her children over because they mauled her child. I want my child to be able to play in our backyard but it is unsafe for any of my family to be in our yard. What is my next course of legal action? Do I really have to wait until my child is mauled?

A: You can sue them for a civil nuisance violation in small claims or county court. But that can be complicated. I recommend speaking with an attorney who can assist you with that situation.
