Q: A Lyft Driver sideswiped my car.

A Lyft driver (while driving a client to their destination) was going well over the speed limit, before, during, and after the collision. Instead of slowing down to yield to existing traffic (me). He tried to go around my car, by going into the oncoming traffic lane. When he tried to merge back, he sideswiped my car.

I was borrowing my brother's car to move apartments. I was under the impression that his insurance covered me seeing as we do not live in the same household and his insurance covered any person who drove his car. However after calling insurances it turned out that I was excluded by my father from the car insurance. Because I don't have an insurance company to represent me, the Lyft insurance is throwing away all of the evidence I provided them and taking sides with the Lyft driver denying he broke the law and hit my car.

What are my options?

beat them to the punch and file in small claims for up to $10k.

if you are not insured DMV may take your license if/when they hear about it.

you won't be able to collect for pain and suffering.
