Houston, TX asked in Criminal Law and Domestic Violence for Texas

Q: How can I avoid going to jail after being arrested for a probation violation for not complying with probation 2nc MTR.

I was in an abusive relationship and my boyfriend wouldn't allow me to go anywhere. He took all the money I had and wouldn't allow me to have a phone.. I am no longer with him and have a stable life with kids again. I want a chance to comply with probation.

A: Hire a local criminal defense attorney to represent you on the MTR. Your choice of counsel should not be driven by price, but rather you should choose a lawyer who will sit down with you and help develop a plan that includes a budget and a detailed schedule for exactly how and when you will comply with every condition of probation.

Your chances are not necessarily great, even with a brilliant attorney and an airtight plan. Your FIRST chance to comply was when you were initially granted probation instead of jail time. Your SECOND chance was when the judge didn't revoke your probation in response to the initial MTR. Now you are asking for a THIRD chance to comply after already failing twice. So even if your MTR is handled perfectly by your attorney there is a decient chance the judge might be unwilling to give you a third chance.
